Terms of Service

These Terms of Service ("Terms") govern access to and use of the Elixor website, AI voice agent platform, APIs, and related services (collectively, the "Services") provided by Elixor, Inc. ("Elixor", "we", "our", or "us"). By using the Services, you agree to these Terms.
1. Eligibility and accounts
You must have legal authority to enter into these Terms. If you use the Services for an organization, you represent that you are authorized to bind that organization. You are responsible for account credentials and all activity under your account.
2. Customer responsibilities
You are responsible for your call scripts, contact lists, consent notices, recording disclosures, legal basis for calling, data submitted to the Services, user permissions, and compliance with laws applicable to your industry and region.
3. Acceptable use
You may not use the Services to engage in unlawful, deceptive, abusive, harassing, discriminatory, or harmful activity; violate telemarketing, privacy, consumer protection, or communications laws; bypass security controls; or interfere with the Services.
4. AI outputs and supervision
AI-generated outputs, transcripts, summaries, classifications, and extracted fields may be inaccurate or incomplete. You are responsible for reviewing outputs before relying on them for legal, medical, financial, employment, or other high-impact decisions.
5. Customer data
As between you and Elixor, you retain ownership of customer data. You grant Elixor the rights necessary to provide, secure, support, and improve the Services according to your agreement and our Privacy Policy.
6. Telephony and third-party services
The Services may interoperate with SIP trunks, PBX systems, carriers, CRMs, analytics tools, and other third-party services. Elixor is not responsible for third-party services, carrier charges, outages, or terms unless expressly stated in a written agreement.
7. Fees and payment
Fees, included minutes, overages, support terms, and billing periods are described in an order form or checkout flow. Unless stated otherwise, fees are non-refundable and taxes are not included.
8. Confidentiality
Each party may receive confidential information from the other. The receiving party will use reasonable care to protect confidential information and use it only to perform obligations or exercise rights under these Terms.
9. Intellectual property
Elixor owns the Services, including software, models, interfaces, documentation, and related technology. You may use the Services only as permitted by these Terms and any applicable agreement.
10. Disclaimers
The Services are provided "as is" and "as available" unless a written agreement says otherwise. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, Elixor will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill. Any liability cap will be set out in the applicable agreement.
12. Suspension and termination
We may suspend or terminate access if you violate these Terms, create security risk, fail to pay amounts due, or use the Services in a way that may cause legal or operational harm. Upon termination, your right to use the Services ends.
13. Changes
We may update these Terms from time to time. Material changes will be posted on this page or communicated through reasonable means. Continued use after changes means you accept the updated Terms.
